What if I am not the driver / owner of the vehicle at the time of violation?
If you are in the business of renting or leasing vehicles, or if the vehicle was sold or reported stolen at the time of the violation, you may transfer liability of the violation. You must submit a notarized Declaration of Non-Liability Affidavit (PDF)">Declaration of Non-Liability Affidavit and proof that the vehicle was sold, leased, or rented. If the vehicle was stolen, you must have made a timely report to a law enforcement agency indicating that the vehicle was stolen, and submit a copy of that report along with your notarized Declaration of Non-Liability Affidavit (PDF). You may also request a hearing and provide proof of the sale, lease, rental, or theft of the vehicle, and make a statement under oath to the administrative hearing officer to rebut the presumption that you were the owner of the vehicle at the time of the violation, or that the vehicle was stolen.
